For its accession to succeed, it needs decisive support from the EU \u2013 and a&nbsp;solution to circumvent the ongoing blockades imposed by Viktor Orb\u00e1n\u2019s Hungary, Sergiy Solodkyy argues in his policy&nbsp;brief.<\/h3>\n<\/div>\n<h2><!--more--><\/h2>\n<p>[\/vc_column_text][vc_column_text css=\u201c\u201d]<\/p>\n<h2>Ukraine on its path toward EU&nbsp;membership<\/h2>\n<p>The European Union is entering a&nbsp;new and serious stage in its enlargement crisis. Ukraine has breathed new life into the EU, motivating it to overcome the enlargement fatigue that followed earlier accession rounds. Yet the actions of a&nbsp;single member state seem to have rendered the Union unable to seize this oppor\u00adtunity, thus jeopar\u00addising the EU\u2019s broader strategic&nbsp;objectives.<\/p>\n<p>Since submitting its appli\u00adcation for membership in February 2022, Ukraine has demon\u00adstrated an unprece\u00addented level of deter\u00admi\u00adnation in advancing towards EU accession. Despite the full-scale war, the country has been imple\u00admenting reforms, meeting oblig\u00ada\u00adtions, and conducting accession negoti\u00ada\u00adtions at a&nbsp;pace that outstrips that of any previous candidate&nbsp;country.<\/p>\n<p>One of Ukraine\u2019s key integration goals for 2025 is to enter into parallel negoti\u00ada\u00adtions in all clusters. At present, Ukraine is urging its European partners to take the proce\u00addural steps necessary to open Cluster 1 (i.e. Funda\u00admentals) in the near term. The European Commission has acknowl\u00adedged both Ukraine\u2019s substantial progress and the legit\u00adimacy of its expectations.<\/p>\n<h2>Hungary blocks EU accession&nbsp;talks<\/h2>\n<p>Paradox\u00adi\u00adcally, the main obstacle facing Ukraine is no longer a&nbsp;lack of readiness on its part but rather political inertia on the EU side. This is engen\u00addered by Hungary\u2019s unilateral blockade of key steps in the negoti\u00adation process. Thus, in addition to grappling with Russian aggression and internal anti-reform forces, Ukraine must now also deal with the injustice of EU proce\u00addures that allow a&nbsp;single member state to stall the entire&nbsp;process.<\/p>\n<p>Ukrainian civil society, working closely with national insti\u00adtu\u00adtions and EU partners, has played a&nbsp;pivotal role in ensuring reform trans\u00adparency and account\u00adability thus far. However, unjus\u00adtified delays in negoti\u00ada\u00adtions threaten to erode trust in the EU within Ukrainian society, fuel pro-Russian narra\u00adtives and undermine the credi\u00adbility of the enlargement agenda as a&nbsp;whole.<\/p>\n<p>This moment calls for a&nbsp;reassessment of EU proce\u00addures, partic\u00adu\u00adlarly with regard to the need to minimize oppor\u00adtu\u00adnities for individual member states to abuse their veto powers during technical phases in the accession process. The merit-based approach must remain the corner\u00adstone of enlargement policy. Moreover, it may also be time for the EU to seriously consider invoking Article 7&nbsp;of the Treaty on European&nbsp;Union.<\/p>\n<h2>Can the EU keep up with Ukraine\u2019s exemplary&nbsp;speed?<\/h2>\n<p>When Ukraine submitted its appli\u00adcation for EU membership in late February 2022, few took this truly historic step seriously. A&nbsp;country under\u00adgoing a&nbsp;massive attack from an aggressive Russia was not expected to have any realistic prospect of joining the European Union. However, subse\u00adquent events have shown that Ukraine is capable of changing the course of history and overturning old assump\u00adtions. It has withstood Russia\u2019s military onslaught and success\u00adfully challenged the stubborn enlargement fatigue that had set in in the&nbsp;EU.<\/p>\n<p>In June 2022, Ukraine was granted EU candidate status, and in December 2023, EU leaders agreed to open accession negoti\u00ada\u00adtions. One year ago, the EU officially launched accession talks with Ukraine, and Ukrainians quickly got to work meeting oblig\u00ada\u00adtions and completing the proce\u00addures associated with the next stage of the accession process, in hopes of bringing membership&nbsp;closer.<\/p>\n<p>Ukraine continues to demon\u00adstrate a&nbsp;high level of commitment to its European goal. The Ukrainian government, parliament, and civil society have been rapidly building up their expertise, preparing extensive documen\u00adtation, and have pledged to implement all oblig\u00ada\u00adtions with the same levels of deter\u00admi\u00adnation and quality. Ukrainian policy\u00admakers under\u00adstand the signif\u00adi\u00adcance of the moment and have declared their readiness to meet all require\u00adments not just on time but at an even faster pace than other candidate states did during previous rounds of EU enlargement.&nbsp;<strong>The key question remaining is whether the EU is prepared to respond appro\u00adpri\u00adately: not only by matching the swift pace of Ukraine\u2019s decision-making but also by demon\u00adstrating the strategic resolve to welcome the country as a&nbsp;member in the near future<\/strong>. Ukrainian officials have publicly voiced the expec\u00adtation that Ukraine will achieve full EU membership by&nbsp;2030.<\/p>\n<h2>Talks on four negoti\u00adating packages&nbsp;concluded<\/h2>\n<p>To this end, the Ukrainian Government is inten\u00adsively studying and adopting best practices for negoti\u00ada\u00adtions and for the effective, swift imple\u00admen\u00adtation of EU require\u00adments. The Government reports that bilateral screening meetings have already been completed in four of the six negoti\u00adation clusters:<a href=\"applewebdata:\/\/75879639-A04F-4EBC-B1F0-7DBFBDC2271D#_ftn1\" name=\"_ftnref1\">[1]<\/a><\/p>\n<ul>\n<li><strong>Cluster 1 \u2013 Fundamentals<\/strong><\/li>\n<li><strong>Cluster 2 \u2013 Internal&nbsp;market<\/strong><\/li>\n<li><strong>Cluster 3 \u2013 Compet\u00adi\u00adtiveness &amp;&nbsp;inclusive growth<a href=\"applewebdata:\/\/75879639-A04F-4EBC-B1F0-7DBFBDC2271D#_ftn2\" name=\"_ftnref2\">[2]<\/a><\/strong><\/li>\n<li><strong>Cluster 6 \u2013 External&nbsp;relations<\/strong><\/li>\n<\/ul>\n<p>Currently, Ukraine is awaiting decisions from its European partners on the proce\u00addural steps required to open negoti\u00ada\u00adtions on Cluster 1. \u201cUkraine has fulfilled all the necessary prereq\u00adui\u00adsites for opening the first negoti\u00adation cluster,\u201d empha\u00adsizes&nbsp;<strong>Olha Stefan\u00adishyna<\/strong>, Deputy Prime Minister for European and Euro-Atlantic Integration and Minister of Justice.<a href=\"applewebdata:\/\/75879639-A04F-4EBC-B1F0-7DBFBDC2271D#_ftn3\" name=\"_ftnref3\">[3]<\/a>&nbsp;This readiness is supported by finalized roadmaps on the&nbsp;<strong>rule of law<\/strong>&nbsp;and on&nbsp;<strong>public admin\u00adis\u00adtration reform<\/strong>, which are key condi\u00adtions for opening the cluster. The&nbsp;<strong>roadmap on the functioning of democ\u00adratic insti\u00adtu\u00adtions<\/strong>&nbsp;and the&nbsp;<strong>Action Plan on safeguarding the rights of persons belonging to national minorities<\/strong>&nbsp;have also been&nbsp;finalized.<\/p>\n<p>Observers in both Ukraine and the EU have noted that these strategic documents were developed in record time, consid\u00adering their scope and the large number of stake\u00adholders involved\u2014which include government agencies, civil society, and inter\u00adna\u00adtional experts.<a href=\"applewebdata:\/\/75879639-A04F-4EBC-B1F0-7DBFBDC2271D#_ftn4\" name=\"_ftnref4\">[4]<\/a><\/p>\n<p><strong>Cluster 1, Funda\u00admentals<\/strong>, is the always the first cluster to be opened in accession talks. Negoti\u00ada\u00adtions in this cluster will focus on the alignment of core areas of Ukraine\u2019s legis\u00adlation with EU law. One of the most complex and most important clusters, Cluster 1&nbsp;is typically the last cluster to be closed in the negoti\u00adation process. It encom\u00adpasses a&nbsp;wide range of topics that are of critical impor\u00adtance for Ukraine\u2019s Europeanization\u2014including the sustain\u00adability of democ\u00adratic insti\u00adtu\u00adtions, rule of law, anti-corruption efforts, and more.<a href=\"applewebdata:\/\/75879639-A04F-4EBC-B1F0-7DBFBDC2271D#_ftn5\" name=\"_ftnref5\">[5]<\/a><\/p>\n<h2>Ukraine\u2019s formula: inspi\u00adration &amp;&nbsp;Europeanization<\/h2>\n<p>Support for a&nbsp;future EU membership remains very high in Ukraine: 90 percent of Ukrainians want to see their country join the European Union according to a&nbsp;survey conducted by the Kyiv Inter\u00adna\u00adtional Institute of Sociology (KIIS).<a href=\"applewebdata:\/\/75879639-A04F-4EBC-B1F0-7DBFBDC2271D#_ftn6\" name=\"_ftnref6\">[6]<\/a>&nbsp;Ukrainians also generally have a&nbsp;positive attitude toward EU pressure to move forward with reforms: in a&nbsp;November 2024 survey conducted by Info Sapiens on behalf of the New Europe Center, over 60 percent of respon\u00addents considered it appro\u00adpriate for the EU and the US to press for action to combat corruption in Ukraine.<a href=\"applewebdata:\/\/75879639-A04F-4EBC-B1F0-7DBFBDC2271D#_ftn7\" name=\"_ftnref7\">[7]<\/a><\/p>\n<p>However, the same New Europe Center survey also revealed some trend towards increasing scepticism. The percentage of respon\u00addents who believed that \u201cthe EU and the US are looking for excuses to deny Ukraine greater support\u201d had increased slightly compared to a&nbsp;similar survey conducted in 2023.<a href=\"applewebdata:\/\/75879639-A04F-4EBC-B1F0-7DBFBDC2271D#_ftn8\" name=\"_ftnref8\">[8]<\/a><\/p>\n<p>Public demand for Europeanization in Ukraine is strong, creating additional leverage for those promoting a&nbsp;reformist agenda in the country. This leverage has enabled an active civil society, reformers within government insti\u00adtu\u00adtions, and the EU to work together to push through many crucial changes. Thus, the current situation affords a&nbsp;unique oppor\u00adtunity to implement vital trans\u00adfor\u00admation in Ukraine. At the same time, it creates a&nbsp;window of oppor\u00adtunity that other candidate countries can turn to their own&nbsp;benefit.<\/p>\n<p>However, it is crucial that the process of accession be trans\u00adparent and fair, and it must be one that rewards the candidate country for progress made on reform. Recently, tones of frustration have become increas\u00adingly audible in Kyiv, as certain EU member countries appear to be blocking Ukraine\u2019s accession process for no justi\u00adfiable&nbsp;reason.<\/p>\n<h2>Hungary\u2019s campaign against Ukraine\u2019s accession to&nbsp;EU<\/h2>\n<p>Hungary has repeatedly raised objec\u00adtions aimed at delaying or even blocking Ukraine\u2019s EU accession process. Initially, Budapest cited concerns about the rights of national minorities in Ukraine as justi\u00adfi\u00adcation for such action. However, after Ukraine demon\u00adstrated its commitment to addressing these issues, Hungary\u2019s lines of argument changed, and it became possible to discern other motiva\u00adtions that may lie behind a&nbsp;possible veto on its&nbsp;part.<\/p>\n<p>Hungarian officials, including Prime Minister Viktor Orb\u00e1n, have launched an active campaign to discredit Ukraine. Notably, Orb\u00e1n has claimed that Ukraine\u2019s accession would mean that \u201call Hungary\u2019s money<em>\u201d&nbsp;<\/em>would have to be spent on Ukraine.<a href=\"applewebdata:\/\/75879639-A04F-4EBC-B1F0-7DBFBDC2271D#_ftn9\" name=\"_ftnref9\">[9]<\/a>&nbsp;Hungary\u2019s Minister for EU Affairs J\u00e1nos B\u00f3ka has stated that \u201cUkraine can only function as a&nbsp;buffer zone\u201d.<a href=\"applewebdata:\/\/75879639-A04F-4EBC-B1F0-7DBFBDC2271D#_ftn10\" name=\"_ftnref10\">[10]<\/a><\/p>\n<p>Budapest has repeatedly blocked EU sanctions against Russia and has put up obstacles to EU-level military assis\u00adtance to Ukraine. It appears increas\u00adingly likely that Hungary intends to block Ukraine\u2019s EU path without putting forth any plausible justi\u00adfi\u00adcation for doing&nbsp;so.<\/p>\n<p><strong>The resulting reality is one in which Ukrainians are fighting on three fronts: against Russian imperial ambitions, against anti-reform forces within their own country, and against unjust practices within the EU itself.<\/strong>&nbsp;In recent years, most EU countries have demon\u00adstrated their ability to support Ukraine on those first two fronts, i.e., in resisting Russia\u2019s aggression and promoting Europeanization. Now, Ukrainians expect their European partners to support them on this third front as well, demon\u00adstrating solidarity and under\u00adstanding by helping them counter anti-Ukrainian manip\u00adu\u00adlation from within the&nbsp;Union.<\/p>\n<p>In April 2025, Ukrainian civil society organi\u00adza\u00adtions appealed to the foreign ministers of EU countries to increase their efforts to build a&nbsp;consensus on opening negoti\u00ada\u00adtions on Cluster 1, warning that bilateral issues threatened to obstruct the overall accession negoti\u00adation process, while also empha\u00adsizing their full support for what they described as \u201cthe idea that the accession process should follow a&nbsp;merit-based methodology.\u201d<\/p>\n<h2>Orb\u00e1n\u2019s blocking&nbsp;tactics\u2026<\/h2>\n<p>Thus far, EU has managed to achieve a&nbsp;consensus on many proposed actions despite efforts by Hungary to block them, a&nbsp;case in point being the packages of sanctions against Russia (although, Hungary\u2019s objec\u00adtions have at times resulted in the adoption of weaker measures than those origi\u00adnally proposed). Similarly, despite Budapest\u2019s resis\u00adtance, Ukraine has been enabled to make progress on the path toward European integration.<\/p>\n<p>One widely cited example (now considered a&nbsp;case study in creative EU diplomacy) occurred in December 2023, when the EU voted to open accession negoti\u00ada\u00adtions with Ukraine. On that occasion, Hungarian Prime Minister Viktor Orb\u00e1n left the room in which the Council was sitting, enabling the remaining 26 member states to proceed without his veto. Reportedly, then-German Chancellor Olaf Scholz suggested that Orb\u00e1n go out for a&nbsp;coffee break to facil\u00aditate the&nbsp;move.<\/p>\n<p>Ukraine continues to emphasize the impor\u00adtance of dialogue and partnership with all EU member states. This was reflected in Ukraine\u2019s efforts to engage in intensive dialogue with Budapest on national minority issues. However, Hungary has grown increas\u00adingly hostile in its rhetoric towards Ukraine, focussing less on bilateral concerns and taking on a&nbsp;more obstructive stance toward Ukraine\u2019s EU aspirations.<\/p>\n<h2>\u2026 and the search for creative&nbsp;answers<\/h2>\n<p>After allowing the Council to approve the opening of accession talks in 2023, Orb\u00e1n pointed out that the Hungarian government would still have \u201cabout 75 occasions \u2026 to stop this process\u201d (referring to the votes on opening and closing the more than 30 negoti\u00adation chapters). It appears that Budapest is now acting on this threat by blocking the opening of Cluster 1&nbsp;negotiations.<\/p>\n<p>The EU faces a&nbsp;serious dilemma: It must either devise 75 separate \u201ccreative\u201d solutions to persuade Hungary not to block Ukraine\u2019s accession, or it must find one sustainable mechanism that will accom\u00adplish the same thing. The former path would demand a&nbsp;signif\u00adicant investment in insti\u00adtu\u00adtional resources, time, and sometimes financial&nbsp;incentives.<\/p>\n<p>This may be the moment for the EU to review certain technical proce\u00addures involved in the accession process. It should not be necessary for all EU member states to approve the opening of each and every negoti\u00adation cluster or chapter. These are largely technical steps, guided by specific indicators and measurable progress.<strong>The requirement of unanimous approval enables the \u201cbilat\u00ader\u00adal\u00adization\u201d of the accession process, i.e. it allows a&nbsp;single member state to insert polit\u00adi\u00adcally motivated roadblocks into the process, with the result that that state\u2019s domestic interests are allowed to distort the collective agenda. This under\u00admines the EU\u2019s credi\u00adbility and efficiency<\/strong>.<\/p>\n<p><strong>&nbsp;<\/strong>In view of all this, calls for the activation of Article 7&nbsp;of the Treaty on European Union have been increas\u00adingly in frequency. (This mechanism allows certain rights of a&nbsp;member state to be suspended). However, it may be impos\u00adsible to attain the unanimity necessary for this step, as Hungary could well find allies to prevent this&nbsp;scenario.<\/p>\n<h2>No ad-hoc-solutions, please!<\/h2>\n<p>Thus, the EU continues to expend time and resources managing internal obstruction in an attempt to keep its enlargement agenda alive. One recent ad hoc idea was to \u201cdecouple\u201d the accession processes of Ukraine and Moldova and open negoti\u00ada\u00adtions with Chi\u0219in\u0103u only. This suggestion was strongly criti\u00adcized by Ukraine. From&nbsp;<strong>Kyiv\u2019s perspective, such a&nbsp;move would be profoundly unfair\u2014and would amount to punishing a&nbsp;candidate country for the misconduct of an existing member state. It is the latter that should be subjected to condi\u00adtion\u00adality in such a&nbsp;case, not the candidate country.&nbsp;<\/strong>Pursuing Moldova\u2019s accession process separately would increase Ukraine\u2019s isolation, which is exactly what Hungary is aiming for when it promotes the idea of enlargement without Ukraine. The interests of Hungary and Russia coincide strangely on this&nbsp;point.<\/p>\n<p>The blockage of Ukraine\u2019s EU accession could reduce Ukrainians\u2019 motivation to pursue internal reforms and its efforts to cooperate with other candidate countries to achieve joint progress. Thus, its impact would extend well beyond Ukraine and its relations with the EU: Ukraine has been the main driver of the enlargement process. Its isolation could jeopardize security interests of the EU as a&nbsp;whole and would ultimately play into the hands of the EU\u2019s adversaries.<\/p>\n<p><strong>&nbsp;<\/strong>Accession to the European Union repre\u00adsents a&nbsp;corner\u00adstone of Ukraine\u2019s plans for post-war recovery and is a&nbsp;key guarantee of long-term stability. Hungary\u2019s actions undermine these vital&nbsp;objectives.<\/p>\n<h2>Civil society: ready to help \u2013 and in need of&nbsp;support<\/h2>\n<p>Contrived delays in the enlargement process risk discred\u00aditing the EU in the eyes of citizens in candidate countries. The window of oppor\u00adtunity for reforms will gradually close, while voices ampli\u00adfying Russian propa\u00adganda narra\u00adtives (e.g., \u201cEurope doesn\u2019t want Ukraine\u201d) will grow louder. Corrupt elites in candidate countries, along with the Kremlin, would welcome such an&nbsp;outcome.<\/p>\n<p>What Ukraine is seeking is the chance to prove that it can become a&nbsp;success story of democ\u00adratic trans\u00adfor\u00admation. Thus, the reper\u00adcus\u00adsions of failing to give it this chance at the very start of its journey would be especially harmful and dangerous. Blocking or unnec\u00ades\u00adsarily delaying Ukraine\u2019s EU accession process could have wide-ranging negative conse\u00adquences. Under\u00admining enlargement would weaken Europe and hand a&nbsp;victory to those invested in the EU\u2019s&nbsp;decline.<\/p>\n<p>Despite suffering greatly from Russian aggression, Ukraine continues to implement the necessary reforms on its path toward EU membership. Ukrainian civil society, which has been playing a&nbsp;key role in holding its government accountable, remains open to close cooper\u00adation with EU stake\u00adholders to ensure Ukraine\u2019s&nbsp;success.<\/p>\n<p>Non-govern\u00admental experts are actively involved at every stage of the accession process: from preparing documents and partic\u00adi\u00adpating in decision-making discus\u00adsions to providing independent assess\u00adments of reform progress. Many of these experts are formally included in negoti\u00adation working groups respon\u00adsible for each chapter of the EU accession&nbsp;process.<\/p>\n<p>Ukrainian NGOs continue to actively support the European integration agenda although they have been signif\u00adi\u00adcantly affected by the U.S. decision to halt all assis\u00adtance to Ukraine. In this regard, additional support from the EU may be needed to strengthen Ukraine\u2019s independent expertise.<\/p>\n<p>The best guarantee that Ukraine will not backslide on its reformist agenda is the rule that the EU will hold all actors \u2013 not just candidate countries \u2013 to high standards. The EU must seriously consider the long-term risks that result from allowing individual member states to misuse proce\u00addural rules and their privi\u00adleged status in the Union of developed democracies.<\/p>\n<h2><strong>Recom\u00admen\u00adda\u00adtions to the EU and&nbsp;Germany:<\/strong><\/h2>\n<ol>\n<li><strong>The EU should establish sustainable and clear proce\u00addures that prevent manip\u00adu\u00adlation of the accession process.<\/strong>&nbsp;Germany and other member states should consider possible changes to the decision-making method\u00adology for the accession process to prevent a&nbsp;single state (or a&nbsp;visible minority of states) from blocking progress from one technical proce\u00addural stages to the&nbsp;next.<\/li>\n<li><strong>Consider the activation of Article 7&nbsp;as a&nbsp;last resort.<\/strong>&nbsp;Although the EU is unlikely to achieve unanimity on this issue, this mechanism should not go entirely unmen\u00adtioned in EU discus\u00adsions. Germany can explore ways of influ\u00adencing member states that abuse EU proce\u00addures and disregard funda\u00admental EU values. By ignoring Hungary\u2019s current approach, the EU may risk encour\u00adaging other member states to abuse EU proce\u00addures in the same&nbsp;way.<\/li>\n<li><strong>Maintain solidarity against polit\u00adi\u00adcally motivated obstruction.<\/strong>&nbsp;Germany should lead efforts to challenge attempts by member states to block Ukraine\u2019s EU path with no valid justification.<\/li>\n<li><strong>Reject the proposal to decouple Ukraine\u2019s accession process from those of other candidate countries.<\/strong>&nbsp;Decou\u00adpling Ukraine\u2019s process from that of Moldova or other candi\u00addates would unfairly penalize Ukraine for internal EU disputes over which it has no influence. Enlargement policy must be based on fair and consistent&nbsp;principles.<\/li>\n<li><strong>Technical proce\u00addures should not be politi\u00adcized.<\/strong>&nbsp;Germany and other EU member states should actively support Ukraine\u2019s efforts towards an accel\u00aderated accession process, also by opening all six negoti\u00adation clusters by the end of this year. It is crucial that the opening of Cluster 1 (Funda\u00admentals) take place without delay, Ukraine having already fulfilled all the necessary prereq\u00adui\u00adsites. The opening of clusters should be a&nbsp;swift and technical process, while greater political attention from the EU would be more logical at the stage of cluster&nbsp;closure.<\/li>\n<li><strong>Ensure a&nbsp;merit-based accession process.<\/strong>&nbsp;Rather than seeking special treatment, Ukraine is advocating for a&nbsp;fair and trans\u00adparent evalu\u00adation of its reform efforts. Polit\u00adi\u00adcally motivated obstacles will undermine trust in the&nbsp;EU.<\/li>\n<li><strong>Support Ukrainian civil society.<\/strong>&nbsp;EU assis\u00adtance for and engagement with Ukrainian civil society and non-govern\u00admental experts plays a&nbsp;vital role in enabling them to hold their government accountable and drive reform forward.
